These general terms and conditions (hereafter called "General Terms and Conditions") are applicable to online orders of foreign currency by consumers and professional users residing in or with registered offices in the territory of the European Union via the website www.wisseldirect.be (hereafter called "the Website”). The aforementioned Website is provided by G.C.F. NV, with registered office at 1652 ALSEMBERG, Winderickxplein 3 bus 3, registered in the Belgian Central Database for Enterprises (Kruispuntbank der Ondernemingen) under number 0832.602.171.
Please read these General Terms and Conditions carefully before using the Website. If you do not agree with the General Terms and Conditions, please do not use this Website.
Directexchange reserves the right to change these General Germs and Conditions unilaterally. Any changes made to these General Terms and Conditions will not apply to currency that has been ordered prior to the change.
If it should be determined that a provision of these General Terms and Conditions is invalid, void or unenforceable either entirely or in part, this will not have any consequences for the other clauses and provisions of these General Terms and Conditions. Directexchange's non-reliance on a provision of these General Terms and Conditions cannot be interpreted as a relinquishment thereof for the future.
GCF NV is the owner or at least licensee of the copyright on all works contained on the Website, including but not limited to all software, design, text, images, sound recordings, animations and video clips, unless otherwise expressly indicated. Every visitor is granted access to the Website for personal use of the facilities offered. Improper use of the Website is prohibited, and any copying, transmitting, displaying, performing, distributing, licensing, changing or storing of the content of the Website is not permitted. At no time may any content of the Website be used for commercial purposes without prior permission from G.C.F. NV.
Orders via the Website can only be placed by people aged 18 and over. All orders are limited to a maximum exchange value of EUR 7,500.00 per person per order. The minimum order amount is EUR 250.00. The General Terms and Conditions apply to all transactions via the Website. G.C.F. NV has the right to refuse orders if the terms and conditions are not fulfilled.
Foreign currency must be ordered in accordance with the instructions on the Website. Handling fees are charged for carrying out orders. After entering, paying for and submitting your order via the Website, you will receive an e-mail from Directexchange.be confirming your order that contains a description of your order and a reference number. As soon as the order has been confirmed the exchange rate is irrevocably set.
Directexchange.be expressly reserves the right to adjust your order. Our order system will automatically round your request to the smallest possible denomination for your chosen currency. Any resulting adjustment to the amount payable by you and since transferred by you in euros will be settled up with you in cash, in euros enclosed with the delivery of the foreign currency.
Orders are paid for by the customer by direct transfer or debit card. If the payment transaction ends prematurely the order will be cancelled immediately. G.C.F. NV can never be held liable for incorrect or defective operation of the online financial services/payment platforms used by the customer.
Once your order has been confirmed it can no longer be cancelled. The right of withdrawal provided for in Article VI.58 of the Belgian Business Code is not applicable to financial services for which the price is dependent on fluctuations in the financial market which cannot be controlled by the trader and which may occur within the withdrawal period. This applies to services related to exchange transactions and money market instruments.
Upon receipt of the payment, the order placed by you will be sent immediately to the address you provided. The delivery will be made to the delivery address specified by you within three working days. Delivery times received after placing the order via the Website are always indicative. G.C.F. NV can never be held liable for late delivery. To take delivery of an order the recipient must always show proof of identification. If the package cannot be delivered or is not accepted by the person named in the order or his/her representative at the delivery address provided, the order will be made available for collection from your post office within ___ weeks. Orders can only be delivered to addresses within Europe. Delivery to a PO Box address is not possible.
Complaints about the order must be made within eight days after delivery by recorded letter to G.C.F. NV. Delivery to the Customer equates to the day on which the customer has received his/her order in a tangible form. By allowing the aforementioned deadline to pass, the Customer hereby declares that the order he/she placed meets his/her expectations.
G.C.F. NV cannot be held liable, nor deemed responsible, for faults or problems that arise due to the Customer's use of the internet or any other means of communication to go through the order procedure on the Website and subsequent payment by the Customer.
G.C.F. NV does not give any guarantees whatsoever regarding the accuracy, appropriateness, reliability, completeness, virus-free status or validity of the content on the Website. The information services on the Website must not be used for speculation or investment.
G.C.F. will under no circumstances be liable in the following (but not exhaustive) cases:
If you provide us with incorrect details when placing your order;
In the event of damage to your computer equipment as a result of use of the Website;
In the event of technical problems or other reasons that are outside our reasonable control, including war, terrorism, government intervention, natural disasters, epidemics, stock market crashes and strikes;
G.C.F. NV does not give the Customer any guarantee in any area that relates to the security of the payment and/or proper delivery of the order in a tangible form.
If a provision of these General Terms and Conditions, including any exemption clause, proves to be invalid or unenforceable, such provisions will be omitted and will not have any effect on the validity and enforceability of the remaining conditions.
APPLICABLE LAW AND COMPETENT COURTS
Belgian Law is applicable to these General Terms and Conditions. In the event of disputes, the courts of the judicial district of Brussels will be competent.
